Meeting Information

Minutes of the Village of Fayetteville Board of Trustees meeting held Monday February 22, 2010 at 6:00pm.

Mayor Olson called the meeting to order at 6:00pm in the Board Room of the Fayetteville Village Hall.

Mayor Olson led those present in a recitation of the Pledge of Allegiance.


MINUTES FEBRUARY 8, 2010

Trustee Small made a motion to accept the minutes of the February 8, 2010 meeting. Trustee Randall seconded the motion and it was carried by unanimous vote.


203 WASHINGTON STREET – APPLICATION TO THE Z.B.A.

Frank Gattusso of 203 Washington Street came to the board to request approval to apply to the Zoning Board of Appeals for a Use Variance. Because of the moratorium in the R-3 District, the Village Board of Trustees needs to give permission for any actions to be taken in this district.

Trustee Small made a motion to allow the Zoning Board Appeals to accept the variance application submitted by Frank Gattusso for property at 203 Washington Street. Trustee Coleman seconded the motion and it was carried by unanimous vote.

BEAUTIFICATION COMMITTEE – FLOWER POTS

Trustee Small presented the quote from Debruque Greenhouse for the purchase of 30 flower pots. The cost for 30 pots is $3,300. Trustee Small explained that he only received 1 quote back and we need to move forward with the purchase so we are ready for the planting season.

Trustee Small made a motion to purchase 30 flower pots from Debruque Greenhouse for a cost of $3,300 and to hire Debruque Greenhouse to fill 60 pots at a cost of $10,800 and water and maintain pots throughout the 2010 growing season for a fee of $9,600. The program will be funded by donations made to the Village and budgeted funds in this year’s and next year’s parks commission budget. Mayor Olson seconded the motion and it was carried by unanimous vote.

FIREHOUSE RENOVATION UPDATE

Sean Foran, Hueber Bruer, presented the board with a Critical Path Update. Bid dates are open to 45 days and all other dates are tied back to the original 45 days from the bid award date.

Trustee Randall asked if the bid notice had been listed on the Builders Exchange and also is it a requirement of the front-end specifications that in order to bid on the project a set of plans have to be purchased or a bid deposit needs to be made.

Sean Foran said that a set of plans do not need to be purchased and a bid does need to have a bid deposit when submitted.

Sean reviewed the schedule for the temporary facility with the board and the minimal work that will need to be done before moving into the facility.

Sean further reviewed with the board the Codes Review status, current condition and the bid day procedures.

Mayor Olson stated that the Village Clerk will be present during bid openings.

Trustee Randall stated that the Village was suppose to have 13 days to review the 90% documents before they were to go out to bid. Trustee Randall was explicit that he wants all 13 days to review the documents before any notice of bids are advertised.

Trustee Randall asked the board to clarify with Sean if we are authorizing him to advertise the job for bids.

Mayor Olson told Sean that he needs board approval before soliciting any bids for the Fire Department Renovation and that the Village Attorney needs to review all documents before they are advertised for bids.

MEMORY GARDEN

Sean Foran told the board that he has been working as the Construction Manager with Rachel Ristou and the Fayetteville Memory Garden. The project is a work-in-progress and Sean will provide more information at the next meeting.

VETERAN PARK MEMORIAL

Mayor Olson was approached by the VFW about selling memory bricks for the Veterans Park. The VFW would like to replace them twice a year; they will match the existing brick in both size and color.

Trustee Kinsella made a motion to allow the VFW to sell memorial bricks to be installed in Veterans Park. The bricks will have to be similar in both size and color. Trustee Small seconded the motion and it was carried by unanimous vote.

RENTAL LAW

Trustee Randall reviewed the Rental Law with the board and addressed Trustee Coleman’s and Trustee Small’s comments. Many of their comments are procedural in nature and Trustee Randall would like to have Richard Greene discuss these comments. Other comments were as follows:

- How will property owners be notified of the new law?

- Discrimination of renters and their right to privacy. NYS law sees rental property differently than commercial properties.

- Will all apartments be inspected or are there different criteria for owner-occupied rentals?

- Who will be doing the inspections and how often will they be done?

Chris Bollinger has been a Real Estate Broker for over 23 years and he believes that no landlord will absorb the cost of inspection and that the tenants will have to bear the cost. Mr. Bollinger is also concerned because he believes that there are already laws on the books that will address the concerns of the Village without creating an additional Rental Law. We would just be replicating what is already in place.

Sara Bollinger is concerned that it will be very costly and would rather see random inspections; she feels that a Rental Law would be overstating a small problem.

Trustee Coleman would like to see the number of Fire Calls to a multiple family dwelling. Trustee Coleman is concerned that the village could be sued for violating someone’s rights if we create laws that violate people’s privacy.

SENIOR CENTER RAMP

Mayor Olson read through the bids for the construction of the handicap ramp at the Senior Center.

1. Hunter Springs - $39,425

2. American Dreamscapes - $39,400

3. Landscapes East - $34,586

4. Landscapes Etc. - $45,448

5. J&J Landscaping - $32,800

Trustee Kinsella made a motion to authorize Mayor Olson to enter into an agreement with the lowest responsible bidder upon approval of the Village Attorney. Trustee Small seconded the motion and it was carried by unanimous vote.


ABSTRACT #15

Trustee Small made a motion to approve Abstract #15 in the amount of $111,726.22. Trustee Randall seconded the motion and it was carried by unanimous vote.





SIGNAL HILL LIGHTING

Trustee Randall reviewed the following bids for the Signal Hill Street Lights

The following sealed bids for 10 Sternberg Street Lamps were received by 9:30am on February 16, 2010 and publicly opened in the Fayetteville Village Hall Board Room.


1. Graybar Electric Co. Inc.- $16,111.00

2. CED/Baldwin Hall - $15,225.00

3. Solvay Electric - $15,220.00

Trustee Kinsella made a motion to authorize Mayor Olson to enter into an agreement with the lowest responsible bidder for 10 Street Lights upon approval of the Village Attorney and after a written agreement with the Signal Hill Homeowners Association. Trustee Randal seconded the motion and it was carried by unanimous vote.

Trustee Kinsella thanked the Village Clerk for her assistance with the Street Light RFP.


FIRE DEPARTMENT SERVICE AWARDS – 2009

Mayor Olson turned the meeting over to Deputy Mayor Kinsella. Mayor Olson and Trustee Randall recused themselves for the following discussion.

Trustee Small made a motion to accept the following qualified members of the Fayetteville Fire Department for the Service Awards Program for 2009:

Trustee Coleman seconded the motion. Deputy Mayor Kinsella, Trustee Small and Trustee Coleman voted aye. Motion carried.


COUNTY SALES TAX AGREEMENT

Mayor Olson updated the board on the Sales Tax Agreement with Onondaga County. All media calls should be directed to Mayor Donovan of Minoa.

BUDGET UPDATE

Mayor Olson and Clerk Corsette will be meeting on Thursday to review the preliminary budget. Mayor Olson will distribute the preliminary budget to the board members at the next meeting and also set the budget meetings schedule.

TOWN OF MANLIUS BEARD PARK

Trustee Randall made a motion to allow the Town of Manlius the use of Beard Park on August 9, 2010 for an outdoor movie night. Trustee Small seconded the motion and it was carried by unanimous vote.

HISTORICAL PRESERVATION COMMISSION

Chairman Polhamus requested that the Village Board of Trustees create an annual budget of $200 for the HPC to purchase reference materials. The reference materials will be kept at the Village Hall and will be made available to the public.

The board agreed to allow the HPC to spend up to $200/year for the purpose of purchasing reference materials.

ROUNDTABLE

Mayor Olson presented the board with a proposed Business Directory Sign that he would like the Board to consider. Mayor Olson suggested that the Board Members look at the Village of Manlius Business Directory located on Fayette Street.

Mayor Olson reminded the board that the Mayor’s Turkey Dinner is Sunday March 7, 2010 and encouraged attendance.

EXECUTIVE SESSION

Trustee Kinsella made a motion to enter into an Executive Session at 8:20pm for advice of counsel and to include Attorney Spencer and Clerk Corsette. Trustee Small seconded the motion and it was carried by unanimous decision.

Trustee Coleman made a motion to reconvene the regular meeting at 8:45pm. Trustee Randall seconded the motion and it was carried by unanimous decision.

Trustee Small made a motion to adjourn the regular meeting at 8:45pm. Trustee Coleman seconded the motion and it was carried by unanimous vote.
